Welcome to XCARDHK — Hong Kong's premier certified trading card marketplace. By accessing or using our Platform (xcardhk.myshopify.com), you agree to be bound by these Terms of Use. Please read them carefully before making any purchase or using any service.

1. Acceptance of Terms

By accessing our Platform, browsing listings, creating an account, or completing any transaction, you confirm that you are at least 18 years of age (or have parental/guardian consent if younger) and that you accept these Terms of Use in full. If you do not agree with any part of these terms, please discontinue use of the Platform immediately.

2. Acceptable Use of the Platform

You agree to use the Platform only for lawful purposes and in a manner consistent with all applicable Hong Kong laws and regulations. The following activities are strictly prohibited:

• Conducting any fraudulent, deceptive, or misleading activity
• Misrepresenting the authenticity, grade, or condition of any trading card
• Attempting to circumvent any security measures or gain unauthorised access
• Using automated bots or scrapers to extract data from the Platform
• Posting, transmitting, or distributing harmful, offensive, or defamatory content
• Reselling accounts or using multiple accounts to manipulate pricing or availability
• Engaging in any activity that disrupts or interferes with the Platform's operation

XCARDHK reserves the right to suspend or terminate accounts found to be in violation of these terms without prior notice.

3. Account Registration & Security

When creating an account on XCARDHK, you agree to provide accurate, current, and complete information. You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised access or security breach at our contact page

XCARDHK will not be liable for any loss or damage arising from your failure to safeguard your account credentials.

4. Product Listings, Grading & Authenticity

XCARDHK specialises exclusively in PSA (Professional Sports Authenticator) and BGS (Beckett Grading Services) certified trading cards. All listings represent cards as described to the best of our knowledge.

• PSA & BGS grades are assigned by the respective independent grading companies and are final — XCARDHK cannot alter or dispute grades on behalf of buyers
• Population data and market valuations are sourced from official grading registries (PSA Population Report, BGS Pop Report) and may change at any time
• Card images in listings represent the actual card being sold unless explicitly stated otherwise (e.g. "stock image used")
• AI-generated grades and price predictions provided on our Platform are for informational purposes only and do not constitute investment advice

XCARDHK strives for accuracy in all listings but cannot guarantee the future value of any card. Trading cards are collectibles subject to market fluctuation.

5. Purchases, Pricing & Payment

All transactions on XCARDHK are conducted in Hong Kong Dollars (HKD) unless otherwise stated. By completing a purchase, you agree that:

• Prices are subject to change without notice until an order is confirmed
• Payment must be completed in full before an order is processed and dispatched
• All sales are final once payment is confirmed, subject to our Refund Policy
• XCARDHK reserves the right to cancel any order in the event of a pricing error, stock discrepancy, or suspected fraudulent activity, with a full refund issued
• Pre-order purchases are subject to availability; estimated shipping dates are indicative only

We accept credit/debit cards, PayPal, FPS, and bank transfer. All payment data is handled by PCI-DSS compliant processors — XCARDHK does not store full payment card details.

6. Intellectual Property

All content on the XCARDHK Platform — including but not limited to the XCARDHK name, logo, website design, text, images, graphics, data compilations, and software — is the intellectual property of XCARDHK or its licensors, and is protected under Hong Kong and international intellectual property laws.

• You may not reproduce, distribute, modify, or create derivative works from any Platform content without prior written consent from XCARDHK
• Trading card images and associated trademarks (e.g. Pokémon, NBA, WNBA) remain the property of their respective rights holders
• PSA and BGS certification marks are trademarks of their respective companies

7. Disclaimer of Warranties

The XCARDHK Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by Hong Kong law, XCARDHK expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that the Platform will be uninterrupted, error-free, or free of viruses
• Warranties as to the accuracy or completeness of any content, grades, or price data on the Platform

8. Limitation of Liability

To the fullest extent permitted by applicable law, XCARDHK, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform or its services — including but not limited to loss of profits, loss of data, or loss of goodwill — even if XCARDHK has been advised of the possibility of such damages.

In no event shall XCARDHK's total liability to you for all claims related to the Platform exceed the total amount paid by you to XCARDHK in the 12 months preceding the claim.

9. Governing Law & Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong. XCARDHK encourages users to contact us in the first instance to resolve any dispute amicably before commencing legal proceedings.

10. Changes to These Terms

XCARDHK reserves the right to modify these Terms of Use at any time to reflect changes in our business practices, services, or applicable law. We will notify you of material changes via email or a prominent notice on our Platform. Continued use of the Platform after changes take effect constitutes your acceptance of the revised terms. If you do not agree to the revised terms, please discontinue use of the Platform.
